AGB / General Terms of Business
Delivery and Payment Terms for the Weingut Heinz Nikolai (“the winery”)- All previous terms shall no longer apply. This list of terms supersedes all previous versions.
- Since our wines are limited edition, sometimes a particular product may run out before it can be reflected on our list. If this is the case, we reserve the right to substitute an ordered product with a wine of similar or higher quality and/or price (at no additional cost).
- The price paid is for the labeled bottle of wine, packaging (recyclable) and includes 19% VAT (value added tax) at the winery in Erbach. We will gladly take all bottles back at the winery for reuse. No bottle deposit is charged.
- For those buying at our winery, our wines are come packaged in 6-bottle cartons or in 12-bottle cartons upon request (both recyclable).
- Wine Shipment:
Wine will be shipped through the mail or by through a freight service in approved 12-bottle shipping cartons. For those wanting to ship smaller quantities, such as for presents, wine will be shipped in 3-bottle or 6-bottle shipping cartons approved by the Postal Service. Upon request we can ship in decorative gift packaging and incorporate a particular motif on the cover.
The costs for shipment and packaging are paid by the buyer and are passed on directly by the winery for that particular order. No additional charges are included.
We will ship up to 59 bottles by mail. We charge the following prices for packaging and shipment (including 19% VAT):
3 bottles – 6.25 €, 6 bottles – 7.30 € and for 12 bottles – 9.60 €.
If 60 or more bottles are to be shipped, a freight service will be used and the buyer will be charged 0.40 € per bottle. For orders of greater than 300 €, we will discount the freight costs by two-thirds.
We ask you kindly to inspect each shipment upon delivery and should any damage to the shipment be reported directly to the shipping or transport service or company and type and extent of the damage be noted in the shipping documents. This will facilitate the processing of any claims - If located within Germany in selected regions, you may take advantage of our periodic delivery service. If you are listed on our customer list, we will notify you by email. Otherwise, please ask about our delivery dates!
- Right of Refusal:
Customers have the right to return any shipment to the winery within two weeks of delivery for any reason and will receive a full refund for the cost of the wine, excluding packaging and shipment costs. The two-week period begins upon receipt of the shipment. No notice of claim need be given if returned to the winery. Only in the case of a shipment that is not possible through a package delivery service (eg., a shipment exceeding limits) will a notice of claim in writing, through mail, fax or email, be accepted.
To meet the deadline for return the initiation of the return shipment of the goods within two weeks will suffice. The winery shall cover the return shipment cost and liability for the goods. Returns shall be made to:

All shipments will remain our property until payment is received and confirmed at our bank. For those who have contractual agreements with us, contracts and disputes thereof will be governed under the laws of the Federal Republic of Germany. - We guarantee the quality and value for the cost of our wines. If you are not satisfied for any reason with our product or service, please let us know. The potential appearance of tartrate salts is not a valid reason for a complaint for wine or sparkling wine (they are not harmful and appear naturally with ageing).
